Tapvpn Privacy Policy

Introduction And Scope

This Privacy Policy (the “Policy”) sets forth a legally binding engagement between Smart Media Internet Marketing Ltd. (hereinafter referred to as “Tapvpn” and also ‘us’, ‘its’, ‘ours’ and/or ‘we’) and you (hereinafter referred to ‘you’, ‘your’, and/or ‘yourself’), a user/visitor/browser of our websites, products and services, whether registered under an account or not.

Overall, this Policy governs your access and use of the Tapvpn software (the “Software“), the Tapvpn SDK as incorporated in other software or services, the Tapvpn websites (the “Site“, along with its sub-domains and its mobile optimized versions) and any appertaining content, services, components and applications thereto (the “Features“) as offered by us (all of them shall be collectively referred to herein as the “Services“).

This Policy shall supplement our End User License Agreement (the “Agreement”), along with any supplemental guidelines and policies provided by us from time to time, all incorporated herein by reference.

This Policy is applicable to the information collected through your use of our Site, our Software, Services, Features and products. As used herein and elsewhere, the words “collect”, “use”, “process”, “treat”, “disclose” and analogous shall be related to personally identifiable information (the “PI”) and other data that we may collect from our users and/or visitors, including cookies inside a computer and mobile device IDs.

By registering with us or otherwise using our products and services, you thereto consent to the collection, transfer, processing, storage, disclosure and other uses of your PI as described in this Policy.

This Policy shall not apply to third-party products or services available through Tapvpn for which a separate privacy policy is provided. Please review their policies to make sure you agree with the manners in which they collect and process your PI.

Information Collected By Us

In order to use our Services, you will need to disclose your PI to us, including but not limited to:

  • First name, last name, mobile phone number, IP address, physical address, email, username and password.
  • Device ID, data from apps of third parties installed, manufacturer data, browsing history, bookmarks and network settings.
  • Available data regarding malicious applications, files and other potential threats on your device, their behavior and origins.
  • Public data collected as you use our Services (e.g. Log Data). Log Data refers to technical information that is automatically collected by us when you use our Services (e.g. error logs, dump files).

The Software may offer the functionality of using your third-party credentials (e.g. Microsoft, Slack, Google or Facebook) to execute single-sign-on, and in that manner we will also collect your PI as provided to us by such third-party platforms; such as your account data, text, archives, photos, bookmarks, info of your contacts and their common contacts, login data and profile information such as “about me”, “friend lists” and “interests”. We will not collect more information when using such credentials beyond the PI such third parties generally disclose to us via their services. For more information, please refer to the Agreement and policies of such platforms.

If you do not wish to reveal your PI to us, you may still be able to use our Software, but we cannot guarantee that you will be able to use it at its fullest.

How We Use Your Information

We will generally collect, use and disclose your PI to:

  • Provide, operate, maintain, improve, and promote our Site and our products and services.
  • Investigate errors and crashes.
  • Provide customer service, archival and backup functionalities.
  • Provide security and fraud-detection Services.
  • Answer to comments, questions, and requests you submit to us.
  • Verify your e-mail address; send password retrieval links and other account notices.
  • Improve your user experience and provide you with personalized support
  • Enable verification and administering upgrades, updates, development, research, process, safeguard and improvement of our Services.
  • Offer surveys, promotions, newsletters, sweepstakes entries and rewards.
  • Monitor and analyze trends, usage, and activities in connection with our products and services and for marketing or advertising purposes.

We may also share non-personally identifiable information with third parties, such as aggregate user statistics, analytics, demographic information, and web site usage information. We will not share PI with third parties for marketing purposes without your permission. With your consent, these third parties may offer promotions (including email promotions) or sell items or services to you through our services.

Upon the case where our business is or becomes part of any merger, acquisition, financing or similar transaction, or in the event of insolvency or bankruptcy, your PI may be disclosed and otherwise transferred to such entities. Simple use of our services entails your acknowledgement and authorization to such information transfer, if any.

How We Process Your Information

As our user, you will normally be able to manage and select the quantity and type of PI you may reveal to us when using our Services, usually in your account settings. We constantly try to develop our user experience, and continuously work to: (i) notify you concerning the ways in which your personal information may be utilized and shared (overseas included); (ii) preserve the security and protection of your personal details; and/or (iii) enforce the accessibility of your personal information in order for you to exercise your right of correction of said information.

In order to execute your privacy rights, kindly get in touch with us as instructed in the contact section of the Site. Your privacy request must include, at the least, the following information: (i) your complete name, address and/or e-mail address for us to inform you the response to your request; (ii) attached documents testifying your identity; and (iii) a lucid and brief description of the PI with regard to which you seek to enforce any of your privacy rights.

Service Eligibility

You must at least be eighteen (18) years of age, or older—to purchase our products and/or to use our services. Tapvpn does not (knowingly) collects information from persons under the age of thirteen (13).

Information Sharing And Disclosure

We and or our affiliates, clients, contractors, licensors, officers, agents and/or representatives need to protect our interests, upon the case where you are found to be in breach of our Agreement and/or this Policy and in other circumstances. If that becomes the case, we must reserve our right to disclose your PI and, henceforth, we shall have the right to disclose the collected PI and/or data. The following are examples, but do not constitute an exhaustive list:

  • When commanded under applicable law.
  • To encounter any actions that allegedly or factually constitute a contingency or liability for us.
  • In response to a valid request or subpoena from a government or law enforcement agency.
  • To defend the property, rights and integrity of any of our users, advertisers or licensors.
  • To process, manage and oversee legal claims and processes brought against us by third parties (e.g. takedown notices).

 

Information Safeguard Measures

We use industry standard protocols and technology to protect the confidentiality of your registered user information and PI, such as Secure Socket Layer (SSL) technology and secure databases. Your PI is only accessible by a limited number of employees who have special access rights. Notwithstanding the foregoing, please take into account that no security measures are completely guaranteed to avoid unauthorized access, and that the Internet and related transmissions are not secure or error free communication means.

Overall, we implement and maintain reasonable security measures to protect our databases and records from unauthorized access, acquisition, destruction, use, modification or disclosure.

Additionally, if you post information on a public forum, message board, blog or bulletin board, any PI you elect to disclose therein there may or will be read, collected and/or used by other users of such forums and could be used by third parties to send you unsolicited messages.

Sensitive Information

From time to time, our Software or our Services will request you to disclose them sensitive PI (e.g. credit card number, account username and password, racial or ethnic origin, religion, health, sexual orientation, criminal background) in order to complete operations related to our Services. We strongly advise our users to engage in online safety measures in order to protect their financial information.

Newsletters

Occasionally, we will ask you for express permission and approval to receive electronic messages in electronic format which are then sent to an electronic address and that contains a message asking recipients to partake in certain business activities (e.g. newsletters, purchase of products, services, surveys).

Cookies

Periodically, we may place what are known as ‘cookies’ inside your computer for the purpose of tracking and collecting data in regard to your utilization of our Site and Services. These files are small texts that our site transfers to your computer, and which allow us to recognize you and obtain data such as the time in which you browse pages within our Site, time of the day, specs of your computer, session length, etc. We also use what are known as ‘beacons’; these are miniscule files, at times just a pixel in size, and then embedded within our Site and its pages. You can always instruct your browser to refuse cookies and beacons, but in doing that, you may then become unable to use our full service offer.

 

Third Party Services

Our Site may present our commercial partner’s hyperlinks as well as those of other third parties. It is important that you consider that we are not responsible for data practices that are conducted by third-parties or the privacy thereof, and that the way in which such third-parties may assemble, process, handle or utilize your PI is not in our control. When such a link is used to go from our Site to an outside website, our Policy and Terms are redundant and your further browsing is at your personal and ultimate risk.

International disclosure

If you are accessing our Site, you must know that you are may be conveying your PI to Israel and, thus, you hereby permit to such transfer, if any. Please be advised that its authorities may have personal data and privacy laws that differ from those of yours, with different levels of security and rights enforcement.

Some countries implement the EU Data Protection Directive (95/46/EC) regarding the transfer of information. If Tapvpn collects and processes PI disclosed by you to us, by clicking the “I Accept” button or otherwise accepting our Services, you consent to such transfer.

Changes

Periodically, and at the final discretion of ourselves, we may update, change, suspend and/modify or our Site, our services, this Policy and/or our Terms, as found here – http://www.tapvpn.com/tos/, in whole or in part. We hereby reserve such right in order to operate our business and protect ourselves. Your use after any changes indicate your acceptance thereof and we will post a notice regarding such changes on our Site, and may also write an email to you or otherwise notify you.
